Why this policy exists. Our snapshot gives real estate agents and teams powerful automation — AI receptionists, SMS and email sequences, lead pipelines, review requests, and more. With that power comes responsibility. This Acceptable Use & Compliance Policy explains how you may and may not use the tools we provide, and the laws and rules you are responsible for following as a licensed real estate professional.
Real Estate Snapshot provides software configuration and automation templates. We are not a real estate brokerage, we are not a party to any real estate transaction, and we do not provide real estate, legal, tax, or investment advice. You remain solely responsible for your compliance with all applicable laws, regulations, and the rules of your brokerage, MLS, and licensing authority.
1. You Are Responsible for Compliance
- You must hold any real estate license required in the states or jurisdictions where you operate, and you must operate under the supervision and brand requirements of your sponsoring broker where applicable.
- You are responsible for ensuring every automation, message template, landing page, and AI prompt you deploy complies with all applicable federal, state, and local laws and the rules of your MLS and brokerage.
- We provide templates and configuration only. We are not liable for misuse, misconfiguration, or non-compliance arising from how you customize or run the system.
2. Fair Housing
You must comply with the federal Fair Housing Act and all state and local fair-housing laws. When using our tools, you agree that you will not:
- Target, exclude, or segment audiences for housing-related marketing on the basis of race, color, religion, sex, disability, familial status, national origin, or any other protected class under applicable law.
- Write or publish listing copy, ad copy, AI-generated content, or automated messages that express a preference, limitation, or discrimination based on a protected class.
- Use lead-routing, audience filters, or ad-platform targeting in any way that produces a discriminatory effect in the availability of housing.
You are responsible for reviewing all AI-generated and templated content before it is published or sent to ensure it is fair-housing compliant.
3. MLS & IDX Rules
- If you display listing data via IDX/VOW feeds, you are responsible for following your MLS's display, attribution, refresh, and data-use rules.
- You may only use listing photos, descriptions, and data you are authorized to use. Do not scrape, republish, or repurpose listing content in violation of MLS rules or copyright.
- Required disclosures, broker attribution, and "last updated" timestamps must be preserved wherever listing data appears.
4. TCPA, SMS & Calling Consent
Our snapshot can send SMS, email, ringless voicemail, and place or trigger calls. You are responsible for compliance with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, state mini-TCPA laws, CAN-SPAM, and carrier A2P 10DLC requirements. Specifically, you agree to:
- Obtain proper prior express consent before sending automated marketing texts or placing automated/prerecorded calls.
- Honor opt-out requests immediately — include and respect STOP (opt out) and HELP keywords in your SMS flows, and suppress contacts who opt out.
- Scrub against applicable Do-Not-Call lists and respect quiet hours and frequency limits.
- Register your brand and campaigns for A2P 10DLC and use compliant sender identification.
- Not import, send to, or message purchased, scraped, or non-consented contact lists.
5. No Guarantee of Results
While our automation is designed to help you capture leads, follow up faster, and stay organized, we do not guarantee any specific outcome — including the number of leads, showings, listings, closings, commission income, or return on investment. Results depend on factors outside our control, including your market, pricing, effort, follow-up, and execution.
Any figures, calculator outputs, ROI examples, or estimates shown in the product or on this site are illustrative and educational only. They are not appraisals, valuations, financial projections, or promises of performance.
6. Prohibited Uses
When using our snapshot, website, or related tools, you agree not to:
- Violate any applicable law, MLS rule, brokerage policy, or third-party platform's terms of service.
- Send spam, deceptive, or misleading communications, or misrepresent your identity or licensure.
- Use the tools to harass, defraud, or discriminate against any person or group.
- Resell, redistribute, copy, or transfer the snapshot, funnels, AI prompts, or templates to another agency or third party without our prior written authorization.
- Upload or transmit viruses, malware, or harmful code, or attempt to disrupt the Services.
7. Third-Party Services
Our snapshot may connect to third-party services (for example GoHighLevel, Twilio, Stripe, Google, Meta, or AI providers). You are responsible for maintaining your own accounts with those providers and complying with their terms and policies. We do not control those services and are not responsible for their outages, pricing, policy, or availability changes.
8. Enforcement
We may suspend or terminate access to our Services, without refund, if we reasonably believe you have violated this policy or used our tools in a way that exposes us, our other customers, or the public to legal or compliance risk.
9. Changes to This Policy
We may update this policy from time to time. Changes will be posted on this page with the revised effective date. Continued use of our Services after an update constitutes acceptance of the revised policy.
